Overview
1.eHostAsia.com is operated by Superior Edge New Media Solutions Inc. This agreement is between Superior Edge New Media Solutions Inc. (hereinafter eHostAsia) and the client (Hereinafter CLIENT) who wishes to avail of eHostAsia’s Business Email Hosting solution. eHostAsia may, without notice to you, at any time amend these Terms and any other information contained on this website. The latest Terms will be posted on our website, and you should review the Terms prior to using the services. Your continued use of the services after any changes to these Terms are posted will be considered acceptance of those changes

2. Mail Relay
Generally, we do not allow bulk or commercial e–mail to be sent to more than five–thousand (5,000) users per day at a rate of 250 messages every 20 minutes. If you would like to send more than 5,000 messages per day, please contact a member of our support team for additional information.

3. Authenticated SMTP Policy
In addition to the requirements above, you may not send email messages of similar content through eHostAsia's SMTP servers to more than two–hundred and fifty (250) recipients. Attempts to circumvent this restriction by breaking up bulk email over time, using multiple accounts, or other means will be a violation of this restriction. eHostAsia may block mail that violates this AUP. In addition, your mail services may be suspended or terminated for violation of this AUP. You may not intentionally use your Mail Service for the purpose of receiving bulk email from others. For example, you may not submit any Mail Service email address to a "Safelist" or "Free for All" (FFA) list. Mail messages sent to other users within your domain names hosted on the eHostAsia system are not Bulk Mail.

4. Management of the Service
eHostAsia will provision your initial mail environment, but you are otherwise responsible for managing your mail service, including adding mailboxes, managing settings, and configuring spam filters.

5. Filtering
eHostAsia will provide email filtering services designed to filter spam, phishing scams, and email infected with viruses. eHostAsia recommends that you employ additional security measures, such as a desktop virus scanner and firewall, on computers that are connected to the Internet. eHostAsia will use commercially reasonable efforts to deliver your email messages. You acknowledge that the technological limitations of the filtering service will likely result in the capture of some legitimate email and the failure to capture some unwanted email, including email infected with viruses. You hereby release eHostAsia and its employees, agents, affiliates, and third party suppliers from any liability for damages arising from the failure of eHostAsia's filtering services to capture unwanted email or from the capture of legitimate email, or from a failure of your email to reach its intended recipient as a result of a filtering service used by the recipient or the recipient's email service provider.

6. Memory Limitations
Mail that exceeds the storage limit when received may be permanently lost. It is your obligation to monitor the storage capacity of individual mailboxes and delete or archive as needed.

7. Payment, Refunds, Money back Guarantees
The email service is PREPAID. CLIENT shall renew and pay eHostAsia recurring or renewal fees a week before the current subscribed month ends should they wish to continue the service for the following month. Failure to renew within the last week of the current subscribed month means you are allowing our system to automatically delete the mailboxes at the end of your subscribed month.
Renewal fee is due within seven (7) days of invoice date which is the 20th of every month. You agree that eHostAsia will delete mailboxes of accounts if these are not renewed ten (10) days after the invoice date which is also the end of your current subscribed month.

No refunds will be given, for any reason, to accounts that are older than 30 days, this includes, but is not limited to data loss, server or systems being unavailable, or websites being unavailable.
Accounts that are terminated by eHostAsia due to a violation of these terms are not eligible for a refund, under the 30 Day Money back Guarantee.
A 1 year contract/prepayment is a 1 year commitment.
Accounts that pay in advance for a specific period are not eligible for a refund if the client cancels the account after 30 days from the start of the service, or the account is terminated by eHostAsia due to a violation of these terms.

8. Limitation of Liability
If we are faced with a legal claim by a third party arising out of your actual or alleged gross negligence, failure to meet the security obligations required by the agreement or violation of the AUP, then you will pay the cost of defending the claim (including reasonable attorney fees) and any damages award, fine, or other amount that is imposed on us as a result of the claim. Your obligations include claims arising out of the acts or omissions of your employees, any other person to whom you have given access to the Services, and any person who gains access to the Services as a result of your failure to use reasonable security precautions, even if the acts or omissions of such persons were not authorized by you.

9. Force Majeure
Neither of us will be in violation of the Agreement if the failure to perform the obligation is due to an event beyond our control, such as significant failure of a part of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labor action, terrorism, or other events of a magnitude or type for which precautions are not generally taken in the industry.

10. No unlawful or Prohibited Use.
You agree not to upload, post or otherwise transmit via the Online Mediums any content that: (i) is misleading, harmful, threatening, abusive, harassing, defamatory, offensive, violent, obscene, pornographic, vulgar, libelous, racially, ethnically, religiously or otherwise objectionable; (ii) constitutes unauthorized disclosure of personal or confidential information; (iii) infringes any patent, trademark, trade secret, publicity right, privacy right, copyright or other intellectual property or any rights of any party; (iv) contains viruses, Trojan horses, Worms, corrupted files or code, files and programs designed to impede or destroy the functionality of any computer software or hardware; spyware and malware designed for phishing and with a view to compromise the data security and integrity, and obtain sensitive personal or financial information.
